01Acceptance of terms

The website fairplaywatch.com is published by JABJAB-IT, an EURL registered in France under SIREN 933 875 536, whose registered office is at 228 bis avenue de l'Argonne, 33700 Mérignac. Its Gérant, Julien Martin, is the director of publication. Full company details appear in clause 2 and in the footer of every page.

By accessing fairplaywatch.com, browsing its content or submitting information through any of its forms, you agree to be bound by these Terms & Conditions and by our Privacy Policy, which is incorporated into these terms by reference. If you do not accept them, you must stop using the website.

If you use this website on behalf of an organisation, you confirm that you are authorised to accept these terms on that organisation's behalf.

"You", "user"

Any person accessing the website, whether or not they submit information.

"Operator"

Any company offering online gaming, betting or gambling services to the public.

"Content"

All text, assessments, ratings, data, graphics, code and other material published on the website.

"Submission"

Any information you send us through a form, by email or by any other channel, including case reports and attachments.

03Eligibility and age

This website is intended exclusively for persons aged 18 years or older, or the higher minimum age applicable in your jurisdiction. By using the site you confirm that you meet this requirement.

You are responsible for ensuring that accessing information about gambling services is lawful where you are located. We make no representation that the content is appropriate or available for use in every jurisdiction, and access from territories where it is unlawful is prohibited.

04Nature of our service

To avoid any misunderstanding, we set out plainly what we are and are not.

4.1 What we do

An assessment reflects our reasoned opinion based on the evidence available at the time of publication. It is not a warranty, endorsement or recommendation, and it may become outdated without notice.

05Permitted use

Subject to these terms, we grant you a limited, non-exclusive, revocable licence to:

• access and view the website for personal, non-commercial purposes;
• print or download individual pages for your own reference;
• quote short extracts in journalism, research or education, provided the source is clearly attributed to FairPlayWatch with a link to the original page.

06Prohibited conduct

You must not:

1. submit false, misleading or fabricated information, or file a report in the name of another person without their authority;
2. use the reporting service to harass an operator, an employee or another player, or to pursue a vexatious campaign;
3. copy, scrape, mirror, resell or systematically extract the content, whether manually or by automated means;
4. present our assessments as an endorsement, or use our name, logo or ratings in marketing material without prior written permission;
5. attempt to gain unauthorised access to any part of the website, its servers or connected systems;
6. introduce malware, attempt denial-of-service attacks, or otherwise interfere with the availability of the service;
7. transmit content that is unlawful, defamatory, obscene or infringes the rights of a third party;
8. use the website in breach of any applicable law or regulation.

Serious misuse may be reported to law enforcement, and we reserve the right to preserve relevant records for that purpose.

07Submissions and accuracy

When you send us a report or other submission, you represent that the information is truthful and complete to the best of your knowledge, and that you are entitled to share it.

• You retain ownership of your submission. You grant us a non-exclusive, royalty-free, worldwide licence to use, store, analyse and reproduce it for the purpose of assessing the case, referring it to a regulator, and publishing anonymised research derived from it.
• We are under no obligation to investigate any particular submission, to reach a conclusion within a stated time, or to publish an outcome.
• We may decline a report that is outside our scope, unsupported by evidence, already before a court or regulator, or filed in bad faith.
• Knowingly submitting false information may expose you to civil or criminal liability and will result in the closure of the case.
• Do not send passwords, one-time codes or complete payment card numbers. We do not need them and will delete them if received.

08Intellectual property

All content on this website — including the assessment framework, scoring methodology, written analysis, layout, graphics, source code and the FairPlayWatch name and logo — is owned by FairPlayWatch or its licensors and is protected by copyright, database and trade mark law.

Except as permitted in clause 5, no part of the website may be reproduced, adapted, distributed or communicated to the public without our prior written consent. Requests for reproduction licences should be sent to [email protected].

If you believe content on this site infringes your rights, notify us with sufficient detail to identify the material and your claim. We assess every notice and remove infringing material where the claim is substantiated.

09Third-party links

The website links to regulators, support organisations and other external resources. Those links are provided for convenience and information only. We do not control third-party sites, do not endorse their content, and accept no responsibility for their availability, accuracy or privacy practices. Visiting them is at your own risk and subject to their terms.

• loss arising from the acts, omissions or insolvency of any operator or third party.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Where liability cannot be excluded, it is limited to the minimum permitted by law.

If you are a consumer, these terms do not affect your statutory rights, which apply in addition to them.

12Indemnity

You agree to indemnify and hold harmless FairPlayWatch and its personnel against any claim, liability, loss or reasonable expense arising from your breach of these terms, from your misuse of the website, or from a submission that is false, unlawful or infringes the rights of a third party.

13Responsible play notice

Gambling involves financial risk and can become addictive. Never gamble with money you cannot afford to lose, never gamble to recover a loss, and never treat gambling as a source of income.

If you are worried about your own play or someone else's, confidential support services are available in most countries, free of charge and around the clock. 14Suspension of access

15Availability and changes

16Governing law and disputes

These terms and any non-contractual obligations arising from them are governed by French law, JABJAB-IT being established in France. The courts within the jurisdiction of Bordeaux have exclusive competence, except that a consumer resident in the European Union may also bring proceedings in, and benefit from the mandatory consumer protection rules of, their country of residence.

17General provisions

Entire agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the website.

Severability

If any provision is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is replaced by one that most closely reflects its intent.

No waiver

Failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment

You may not assign your rights under these terms. We may assign ours to a successor organisation carrying on the same public-interest function.

Third parties

No person other than you and FairPlayWatch has a right to enforce any provision of these terms.

Language

The English text is the authoritative version. Translations are provided for convenience only.
